It was brought to our attention that some big online retailers have been sued for overcharging shipping. Example.

To avoid any chance of a lawsuit we were advised to change our terminology to "shipping and processing" as "processing" is flexible but "handling" must occur during the shipping of a package. We charge a flat-rate of $8.50 for all orders, and since we ship mostly books UPS Ground, we usually lose money on shipping. But on the off chance we actually make money and that customer decides to sue us, we want to have all out bases covered.

I looked but cannot see a way to change "shipping and handling", during checkout, to "shipping and processing." Does anyone know how?

You could go into your custom shipping menu and add the text "Processing Included" or "Shipping and Processing" to the notes field for your flat-rate option. In addition, you could have a Shipping Policies page to help explain what you charge and your process and this could help cover you a little bit more.

I appreciate the suggestion and plan to implement it.

Here is my problem. Even if I make those changes our checkout still says:

How can I maker this happen?

The date on that article is 2002, now six years old. If you state in your shipping policies that you shipping is a flat rate of xx.xx and the customer checks the box saying they agree to the terms of the site then you should be covered. I use a flat rate shipping fee plus a handling fee. The handling fee is changed as gas prices increase or decrease.
