I'm sure that anyone adversely affected by changes in their Google SERPs would love to be able to do this successfully, but reading the article makes me think that this would be a bad thing -- not only for users but also for web administrators.

Google Sued Over Drop in SERPs - Free Speech Violation or Just Business?

QUOTE
But think what would happen if KinderStart goes forward with its lawsuit and prevails. Google would be seriously constrained as to the kinds of changes it can make to its algorithms. If the court were to force Google to be more transparent, it could even be compelled to reveal trade secrets. This would hurt users of search engines, because it would discourage innovation. Not just Google, but other search engines as well, would start delivering results that are less relevant, not more. Anyone who has been using search engines over the years knows what kind of frustration that can produce.

The article paints a bad picture of this so-called SERPs victim based on the low-quality and lack of content on their site currently. If they win, it will be bad news for those webmasters and clients that DO have good quality content.

Very interesing, but not anything that many people did not see it coming... Google seems to want to operate the spotlight and also be in it.... meantime all merchants and real content sites are at the mercy of this 'game'....

Nothing is going to come of that. You don't pay Google anything to list you. You can't expect them to never move your free serp listing to someplace else.

Of course, if you sue Google, you make news and that news gets posted on many many sites, some with great page rank and then your site is linked to from the story and those nice incoming links get spidered and your rank rises. I'm calling my lawyer! A good dose of Monday Morning cynicism, tasty.

ya its just a clever media stunt, that has worked perfectly for this company.

When you submit your site to google, you agree that they don't guarantee where you'll place. When you read their guides, they inform you it's just a guideline, and they make no guarantees about anything at any time. Nothing will come of this.

It's a publicity stunt and nothing more. Nothing will change.

Time will tell what will happen with this litigation. Who knows? Maybe the courts will decide against Google if it can be proven that inclusion in their engine makes or breaks a site. If they can materially prove it has affected them -- who knows? I've seen motions granted for truly strange complaints in a court of law.

I doubt they will win.
